Welcome to Plugcamp. These Terms of Service ("Terms") govern your access to and use of Plugcamp's AI-powered tools for Figma, including our plugins, website, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By installing our Figma plugin, creating an account, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

You must be at least 16 years old to use our Service. By using the Service, you represent and warrant that you meet this age requirement.

2. Service Description

Plugcamp provides AI-powered tools integrated into Figma, including but not limited to:

• AI Image Upscaler: Enhance image resolution using AI models
• Image Generator: Create images from text descriptions
• AI Image Editor: Edit and modify images with AI assistance
• Logo Generator: Generate logos and vector graphics
• Vectorizer: Convert raster images to vector format
• Remove Background: Automatically remove image backgrounds

All AI processing is performed using Replicate's infrastructure and models. We reserve the right to add, modify, or discontinue features at any time with or without notice.

3. Account Registration and Security

To use our Service, you must:

• Authenticate through Figma OAuth with a valid Figma account
• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credits and Subscription Terms

4.1 Credit System

• Each tool operation consumes a certain number of credits based on complexity
• New users receive 3 free credits upon registration
• Credits can be purchased as one-time packages or through monthly subscriptions
• Credits are non-refundable and non-transferable
• Unused monthly subscription credits do not roll over to the next billing period

4.2 Payments and Billing

• All payments are processed securely through Stripe
• Subscription fees are billed in advance on a recurring basis
• You authorize us to charge your payment method for all fees incurred
• Prices are subject to change with 30 days' notice to active subscribers
• Failed payments may result in service suspension

4.3 Cancellation and Refunds

• You may cancel your subscription at any time from your account settings
• Cancellations take effect at the end of the current billing period
• No refunds are provided for partial billing periods or unused credits
• One-time credit purchases are final and non-refundable

5. Acceptable Use Policy

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Generate, upload, or process illegal, harmful, or offensive content
• Create deepfakes or misleading content without disclosure
• Attempt to reverse engineer, hack, or compromise the Service
• Abuse, harass, or harm others
• Distribute malware or engage in phishing
• Resell or redistribute our services without authorization
• Use automated tools to abuse our API or credit system
• Bypass rate limits or usage restrictions

Violation of this policy may result in immediate termination of your account and forfeiture of credits.

6. Intellectual Property Rights

6.1 Your Content

You retain all ownership rights to the images and content you upload to our Service. By using the Service, you grant us a limited, non-exclusive license to process your content through our AI tools and Replicate's infrastructure solely to provide the Service to you.

6.2 Generated Content

You own the output generated by our AI tools, subject to these Terms. However, similar content may be generated for other users. You are responsible for ensuring your use of generated content complies with applicable laws and does not infringe third-party rights.

6.3 Our Service

The Service, including its design, functionality, code, and branding, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7. Third-Party Services

Our Service integrates with third-party platforms:

• Figma: Authentication and plugin integration - subject to Figma's Terms
• Replicate: AI model processing - subject to Replicate's Terms
• Stripe: Payment processing - subject to Stripe's Terms

We are not responsible for the availability, accuracy, or content of third-party services. Your use of these services is governed by their respective terms and policies.

8. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Guarantees of uninterrupted, timely, secure, or error-free service
• Accuracy or reliability of AI-generated results
• That defects will be corrected

We do not warrant that the Service will meet your requirements or that AI-generated content will be suitable for your purposes. You use the Service at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLUGCAMP AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Third-party actions or content
• Unauthorized access to your account

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Plugcamp and its affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you upload or generate through the Service

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause or notice, including if:

• You violate these Terms or our Acceptable Use Policy
• You engage in fraudulent or illegal activities
• We are required to do so by law
• Your account has been inactive for an extended period

Upon termination, your right to use the Service will immediately cease, and any unused credits will be forfeited. Sections of these Terms that by their nature should survive termination will remain in effect.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website with a new "Last Updated" date
• Sending an email notification to your registered email address
• Displaying a notification within the Figma plugin

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and cancel your account.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Plugcamp operates, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except that either party may seek injunctive relief in court for violations of intellectual property rights.

14. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Plugcamp
• Severability: If any provision is found unenforceable, the remaining provisions will remain in effect
• Waiver: Our failure to enforce any provision does not constitute a waiver of that provision
• Assignment: You may not assign these Terms without our consent. We may assign these Terms without restriction
• Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control
